This was a blog post I was hoping I wouldn’t have to make. The story starts with losing my Basil three years ago. When I first joined my Corgi—I was one of the first 500 members—I blogged about losing Basil. Basil was my first Corgi and my best friend. On the day before Thanksgiving three years ago I took my two Corgis, Basil and Lizzie, our elderly black lab Golden retriever, Tess and our Leonberger, Rudy for a walk. It was a beautiful day. We live in the country and we walk off leash on a seldom used gravel road near our home. We were on our way back home Basil would run up to check in for a little pat and then scamper up and down the road ditch sniffing for rabbits and anything else that needed a quick chase. It didn’t take long to notice that Basil was absent. I called for him and called as I continued to walk home. I back tracked and found him. Dead in a trap set by a local trapper. I can’t even begin to describe how devastated I was. I still can’t talk about it without crying. I assumed it was illegal to trap in the road ditch, but I was wrong. I couldn’t believe it. The trapper was charged with baiting a trap and using a trap too large. He paid his fine and wrote a pathetic apology note—directed by the game warden. I started to think about how inappropriate it was to legally set traps in the ditch. The game warden agreed. Other hunters are prohibited from hunting in the right-of-way. As a landowner I can’t use the ditch or right of way that is essentially my property for personal use. I can’t graze my horses or hay the road ditch, but at that time…a trapper could set a trap, kill an animal and make a profit off the hide. Not only is that wrong, but, the right of way is for the public use and convenience. When I walk on the road, we always go down in the ditch to get away from cars. The girls would play in the water in the road ditch catching frogs and snakes. My children used to ride their horses in the ditch rather than on the road thinking it was safer. What could happen if one of the horses had stepped in a trap? It scares me to think about it. Think about county workers who mow and manage utilities in the road ditch. It was a bit of a process, but in the following legislative session I (with help from others)was able to have an amendment attached to a bill that made it illegal to trap in the right of way. They called it Basil’s law. The main state newspaper carried his story. Each year since then, one senator has introduced a repeal of the law. Working with the county officials and other interested lobby groups we have been able to defeat the repeal each year. Each year I have to re-live the terrible story and listen to this senator say over and over again “it was just a dog” and have him treat me as if I was a crazy dog lady. Kinda tough since I am also a lobbyist and I need to maintain my credibility, but the issue is important to me and I will work against him for as long as it takes. Ironically this same senator looks to me for support on other issues and for contributions to his election fund. It is important to note that the law only makes it illegal to trap in right of way it doesn’t seek to get rid of trapping, just doesn’t allow it where it is not appropriate or safe. Ditch running is a quick/easy way for trappers to kill furbearing animals so a number of trappers want this repealed as well. If you are from Nebraska please contact your senator and let them know that repealing the ban is not right and that LB 5 should not advance. If you are not in Nebraska check your own state trapping laws. Most states don’t allow it, but if yours does it may be time for a change. Thanks for letting me share this.

I think Theresa's letter is a great template. Since the bill is on the floor tomorrow contacting individual senator's right now is the best option. Nebraska is a conservative state. it is important to keep this issue about what makes sense and not just about trapping. Like most elected officials, they are going to be most concerned about messages from their constituents, but all information is valid. I am at work now. I will put a new post together when I get home! Thank you to everyone who has shown such concern and compassion regarding this issue!

Theresa, that is an awesome letter! I will share it with others that are not on MyCorgi! It looks as though the bill has a good chance of coming up on the floor on Friday. The speaker is scrambling for bills to be discussed so he asked for them to be expedited out of committee. This means it didn't even get a legitimate discussion in Committee.

OK, DOG LOVERS of all breeds - it is important to the write your senator in Lincoln or in the state where you live because this is IMPORTANT. I am including my letter to my senator and to the Natural Resource Committee for your reference - if you agree with it you can use it - But the IMPORTANT thing is to write. And if you don't think you need to then just google "dog caught in conibear trap" under images. . .

Thank you for hearing all testimony on LB5. I urge you not to advance LB5 that would repeal the ban set by LB299 in 2007 that prohibits trapping wildlife in county road rights-of-way.

You have heard testimony that the problems caused by traps in county road right-of-way are due to illegal traps placed by people who ignore the current ban. It is the location of the trap that is the issue, not if it is legally or illegally set.

According to 37-513 “Shooting at wildlife from highway or roadway; trapping in county road right-of-way; violation; penalty. (1) It shall be unlawful to shoot at any wildlife from any highway or roadway, which includes that area of land from the center of the traveled surface to the right-of-way on either side…” Why are Nebraska senators considering giving right-of-way trapping special consideration?

It is not my intent to stop anyone from hunting or trapping, however in my opinion, trapping a right-of-way is wrong. I do not believe that a trapper will deprived the opportunity to trap because ditches are now off limits.

Some have raised the argument that a trapper should be required to get permission from the adjoining landowner before trapping in the right-of-way because it places the landowner and his animals at risk. A landowner often maintains the right-of-way next to his land. I do believe that if the landowner would give permission to trap the right-of-way, the landowner will most likely give permission to trap on their land, which would allow the traps to be set on private land not in the right-of-way.

Proponents have indicated that LB 5 was introduced so animals that are damaging county roads can be trapped. It there is legitimate damage to the right-of-way, then the county entities should contact Game & Parks and work together to create a special depredation permit which would authorize trapping for the management and control of these animals. G & P would need to use proper signage and public awareness to alert the public of the traps in the right-of-way. Game & Parks already has a database of trappers that they can contact for depredation.

Proponents of the ban have argued that the public should not be in the right-of-way. I live in rural Nebraska I have ridden horses, walked dogs, and picked up trash in the county road right-of-way. All legitimate reasons to be in the right-of-way.

Larry Dix, executive director of the Nebraska Association of County Officials, has offered the following alternatives, I have included my thoughts.

- To have the traps flagged to call attention to them. Ethical trappers have a legitimate concern that this will allow unethical trappers or animal rights activists to take the trap or rob it.

- To require the completion of a mandatory training to obtain a trapping permit. How would this resolve the issue of the location of the trap? I do support the idea that a person who holds a Fur Harvest permit must first obtain a certificate of trapper education program like the one for hunter education that Nebraska currently has in place for firearms and bow hunting.

- To granting counties the authority to pass trapping ordinances. This would add confusion to the issue if someone is trapping across two or more counties.

Bad News... The Natural Resources Committee advanced the repeal of Basil's Law with only one "no" vote. I will continue to communicate with members of the legislature, but it oesn't look good. Not a good day for me.
